AGREEMENT
Acceptance: A deposit for a booking constitutes the Traveler's acceptance of these Terms & Conditions.
Land Deposit: 30% of the booking price.
A land deposit, together with full payment for air services (if applicable), is required to confirm reservations. At the time of quotation, the Traveler will be advised if the supplier responsible for the itinerary requires a larger deposit. Deposits are non-refundable. Majestic African Safaris strongly recommends that Travelers purchase Travel Protection Insurance, which may provide reimbursement of non-refundable deposits and other covered losses resulting from a covered event.
Group Reservations: Groups are defined as reservations for 10 or more guests. Separate conditions apply to groups and will be provided directly.
Air Payment: In addition to the required Land Deposit, airline reservations (when requested) must be paid in full and ticketed to confirm space and applicable airfare. Airline payment and ticketing deadlines are separate from, and in addition to, the land deposit and final payment deadlines.
Airline regulations require the full legal name, date of birth, and gender of each traveler exactly as shown on their passport. Travelers must provide a copy of the passport photo page for each passenger. Failure to provide accurate passport information may result in a US$250 per ticket administrative fee, in addition to any applicable airline change fees.
Airfares are not guaranteed until full payment has been received and processed by Majestic African Safaris. Airline tickets are subject to the applicable airline's fare rules and conditions, which will be disclosed at the time of booking.
Airline Seats & Ancillary Requests: Majestic African Safaris is happy to assist with advance seat requests whenever available. For many Business Class fares, advance seat selection is included as part of the airline ticket. For Economy Class and other fare types, airlines may charge an additional fee for advance seat assignments, or complimentary seat selection may not be available until check-in. Travelers may also select or modify seats directly through the airline once tickets have been issued.
Requests for special meals, additional baggage, internet access, wheelchair assistance, and other ancillary services may also be made directly with the airline. Airline seating, ancillary services, fees, and schedules are controlled by the carrier and are subject to change without notice. We recommend confirming these details directly with the airline prior to departure.
Itinerary Changes: Once a deposit has been received, a US $150 per booking change fee will apply. Additional fees may also be charged by hotels, safari operators, airlines, rental car companies, or other service providers. Any applicable fees will be advised at the time the change is requested.
Payment: Prior to final payment, Travelers will receive a final invoice reflecting any approved itinerary changes and any applicable currency fluctuations. Prices are not guaranteed until full payment has been received. Price adjustments may also occur as otherwise described in these Terms & Conditions.
Final Payment: Final payment for all individual and group bookings is due 90 days prior to departure unless otherwise specified at the time of booking. Reservations made within 90 days of departure require full payment at the time of booking. Failure to make payment by the due date may result in cancellation of the reservation, and the Traveler will be responsible for any applicable cancellation charges.
Cancellations: Unless otherwise advised in writing at the time of booking, the following cancellation schedule applies. Certain suppliers may require different deposit requirements, payment schedules, or cancellation penalties. Where applicable, those supplier-specific terms will be disclosed before a deposit is accepted and will supersede these standard Terms & Conditions.
Majestic African Safaris will administer cancellations in accordance with the cancellation terms applicable to the Traveler's booking. Requests for discretionary exceptions, waivers or goodwill refunds are considered solely at the supplier's discretion. Majestic African Safaris is under no obligation to negotiate exceptions to a supplier's cancellation policy. Any exception voluntarily granted by a supplier will be passed on to the Traveler.
Cancellations received by 120 days or more prior to departure are subject to a cancellation fee of 20% of the total retail tour price.
Cancellations received 119–60 days prior to departure are subject to a cancellation fee of 50% of the total retail tour price.
Cancellations received 59 days or less prior to departure are subject to a 100% cancellation fee of the total retail tour price.
Travel Protection: Majestic African Safaris strongly recommends that all Travelers purchase comprehensive Travel Protection Insurance to protect their travel investment. Safari arrangements often involve substantial non-refundable payments made well in advance of departure. Travel Protection Insurance may provide reimbursement for covered losses resulting from unforeseen events such as illness, injury, family emergencies, flight delays, baggage loss, trip interruption, or other covered events.
We will provide information regarding available Travel Protection plans with your quotation. Travelers are responsible for reviewing the policy to determine whether it meets their individual needs. Coverage is subject to the terms, conditions, limitations, and exclusions of the insurance policy. Benefits, limits, and availability may vary by state or jurisdiction. Claims for covered losses should be submitted directly to the travel insurance provider.
Late Bookings: Reservations made within 30 days of departure will incur a US$100 Late Booking Fee. This fee covers the additional administrative time required to expedite confirmations, coordinate supplier arrangements, and process travel documents.
Documents: Provided full payment has been received by the applicable due date, travel documents will be emailed approximately 2–3 weeks prior to departure, or as soon as they are received from the applicable supplier. Travelers are responsible for reviewing all travel documents immediately upon receipt and notifying Majestic African Safaris of any errors or discrepancies.
Prices: All prices are quoted in U.S. dollars and are based on supplier rates, government taxes and fees, park and conservation fees, and applicable exchange rates in effect on the date of quotation. Prices are subject to change until full payment has been received. Unless otherwise stated on the Traveler's itinerary, exchange rates are not guaranteed until final payment is made.
Children: Some safari camps, lodges, and other travel services have minimum age requirements or restrictions for children. Travelers planning to travel with children must advise Majestic African Safaris at the time of booking and provide a copy of the passport photo page for each traveling child so that age eligibility can be verified before reservations are confirmed.
Passports & Visas: Travelers are solely responsible for obtaining and carrying all required travel documents, including valid passports, visas, vaccination certificates (where required), and any other documentation necessary for entry into, transit through, or departure from the countries included in their itinerary.
U.S. and Canadian citizens must have a passport valid for at least six (6) months beyond the completion of travel and with sufficient blank visa pages for entry and exit stamps. Visa requirements vary by destination and nationality. Travelers are responsible for verifying all passport, visa, health, and entry requirements with the appropriate government authorities prior to departure.
Travelers who fail to obtain or carry the required documentation may be denied boarding or refused entry into a destination. Majestic African Safaris accepts no responsibility for any costs, losses, penalties, or expenses resulting from incomplete, incorrect, expired, lost, or stolen travel documents or a Traveler's failure to comply with applicable entry requirements.
Limitation of Liability: Majestic African Safaris acts solely as an intermediary in arranging travel services and does not own, manage, control, or operate the airlines, safari operators, destination management companies, accommodations, transportation providers, guides, or other independent suppliers that provide services for your itinerary. All such suppliers are independent contractors.
Majestic African Safaris is not responsible for any negligent or wrongful act, omission, default, or failure of any independent supplier or other third party. Furthermore, Majestic African Safaris shall not be liable for any injury, illness, death, loss, damage, delay, inconvenience, or additional expense arising from acts of God, force majeure, government actions, war, civil unrest, labor disputes, terrorism, supplier insolvency, overbooking, transportation delays or failures, mechanical breakdowns, adverse weather, wildlife, insects, marine life, food poisoning, epidemics, pandemics, inadequate medical care, evacuation difficulties, or any other event beyond its reasonable control.
Relationship of the Parties: Majestic African Safaris acts solely as an independent travel advisor and intermediary between the Traveler and the independent suppliers providing the travel services included in the itinerary. Majestic African Safaris does not own, operate, manage, or control any airline, safari operator, destination management company, hotel, lodge, transportation provider, or other travel supplier.
All travel services are provided by independent contractors. Majestic African Safaris has no control over the quality, safety, legality, scheduling, pricing, or performance of those services and cannot guarantee that any supplier will fulfill its obligations exactly as described. The Traveler's contractual relationship for the provision of travel services is with the applicable supplier.
Disputes and Indemnity: Any dispute regarding the services provided by an independent supplier is ultimately between the Traveler and that supplier. While Majestic African Safaris may, at its sole discretion, assist in communicating with the supplier or facilitating a resolution, Majestic African Safaris has no authority to require a supplier to issue a refund, modify its policies, or otherwise resolve a dispute in the Traveler's favor.
The Traveler agrees to release Majestic African Safaris and its officers, employees, and agents from any claims, demands, damages, liabilities, costs, or expenses arising from or relating to any dispute with an independent supplier. The Traveler further agrees to indemnify and hold harmless Majestic African Safaris from any liability, loss, claim, or expense arising out of such disputes.
Forum and Binding Arbitration: Any dispute concerning, relating or referring to this Agreement, the brochure or any other literature concerning relating to the Traveler's trip, or the trip itself, shall be resolved exclusively by binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. Sections 1-16, according to the then existing Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS). Please understand that by agreeing to these terms and conditions, the Traveler and Majestic African Safaris are waiving our right to a trial by jury. Any arbitration commenced against Majestic African Safaris must be on behalf of only the signatory to this Agreement and his or her immediate family members who travelled with the signatory and that signatory's accompanying immediate family members (such as a spouse or dependent child). Under no circumstances can Traveler be part of a class or other joint action.
Validity: Majestic African Safaris reserves the right to amend these Terms & Conditions at any time without prior notice. The Terms & Conditions in effect on the date a booking is confirmed shall apply to that booking.
